To ensure that your investments in a Self-Directed IRA (SDIRA) are compliant with IRS regulations and our custodial policies, you will need to submit various forms and documentation. Below, we've outlined the documentation requirements for common investments, including instructions on where to find all necessary forms.
Investment Documentation Requirements
Fund a Private Placement: To fund a Private Placement, you will need to create a Direction of Investment (DOI) and attach the following documents:
- Private Placement Memorandum (PPM)
- Signed Operating Agreement
- Subscription Agreement, including:
- Investment amount

- AET's Tax ID: 20-8936642
- IRA titling as “(Account Holder Name), Legal Owner Via Non-Trust Custodial IRA with AET”
- Hold Harmless Form
Fund a Secured Loan or Promissory Note: For a Secured Loan or Promissory Note, submit a DOI with the following:
- Loan Documents or Promissory Note: Lender information should be in the name of the IRA as “Account Holder, Legal Owner via Non-Trust Custodial IRA with AET”
- Include asset/interest security details, payment amount, principal, interest, start and end dates.
- Signed and dated by the borrower.
- Supporting Documents: Security documentation, such as a mortgage statement or deed, if secured by property.
Fund an Unsecured Loan or Promissory Note: To fund an unsecured loan or promissory note, provide:
- Loan Documents or Promissory Note: Lender information must be titled as “Account Holder, Legal Owner via Non-Trust Custodial IRA with AET”
- Include borrower details, payment amount, principal, interest, start and end dates, and signed date.
- Amortization or Payment Schedule (if required).
- Loan Hold Harmless Form: Complete, print, and sign the form.
Fund a Deed of Trust (DOT): To fund a Deed of Trust, submit the following documents:
- Loan Documents or Promissory Note with IRA titling: “Account Holder, Legal Owner via Non-Trust Custodial IRA with AET”
- Include payment amount, principal, interest, and terms of the DOT.
- Deed of Trust (DOT).
Funding an LLC: For first-time LLC funding, submit a DOI with the following:
- Completed and Signed LLC Operating Agreement
- LLC EIN (SS4)
- Membership Certificate (if available)
- Member/Ownership Ledger
- Include the name of the LLC and the account holder’s name, along with the contribution amount from the IRA.
- LLC Funding Hold Harmless Form
Funding a Limited Partnership: To fund a Limited Partnership, create a DOI with these documents:
- Limited Partnership Agreement (signed by the manager)
- PPM (Private Placement Memorandum)
- Company EIN (SS4)
- Subscription Agreement with IRA titling and AET’s Tax ID and address.
